If payments are not made regularly the decision maker should
establish from
1) any court order or
2) the terms of any written or oral voluntary agreement or
understanding whether there is a requirement or an intention to pay
regularly, for example, weekly or monthly.
Example
A woman makes a payment of £25 to the applicant, her ex-husband to buy a new coat for their daughter. She has made similar payments before but not regularly and regular voluntary payments of £10 a week, for her daughter's maintenance. The decision maker treats the regular payment as income and the £25 as capital.
