The decision maker should treat lump-sum payments of
compensation as capital. These include payments
1) of death benefit under the PB and MDB Scheme
2) under the NCB's (or British Coal's) Pneumoconiosis
Compensation Scheme
3) of damages for the death of a child's father or to a woman
for the death of her partner1
4) at common law for injury or death (including vaccine
damage payments)by the Criminal Injuries Compensation Board.
Note the decision maker should disregard (DMG44008(24))
payments made under (4)
. and (5)
. above which are held in trust and treat any capital which
is released from the trust as in DMG41012 onwards.
