The decision maker should also ensure that the expert has explained

1) whether on the facts of the case there is any market demand for the deemed share and where the market lies and
2) how the value has been calculated and
3) either


  • been arrived at without using comparables and what comparables have been relied on or
  • how the valuation has

4) whether the valuer has any experience or knowledge of the sale of an undivided share in the circumstances of the applicant's case.

Note a valuation arrived at simply by dividing the value of the property as a whole by the number of owners and given a single discount to reflect the restricted demand for a part share does not meet the requirements of the regulations.
