Decision Makers Guide - DMG41034

Ownership disputed

If applicants allege less interest in capital than the evidence shows, the decision maker should get written evidence of any beneficial interest they own1. Such evidence may cover why and how the capital came to be in their name or possession. If it is claimed that the money is held for someone else, the decision maker should get evidence of

  • the arrangement and
  • the origin of the money and
  • the intentions for its future use and return to the rightful owner.
