Decision Makers Guide - DMG39015

Students: Full-time course

There is no statutory definition of full-time course. The decision maker should note the following guidelines

1) the question whether a person is a student attending a course of FTE is one fact to be decided by the decision maker

it is the course and not the student, which must be full-time at it is therefore irrelevant how many hours the student actually attends

evidence should be obtained from the educational establishment about the course's description as full-time ought to be accepted as conclusive unless there is strong relevant evidence to the contrary a modular course that allows a student complete flexibility to attend the course on a full-time basis, a part-time basis or a combination of both, and to switch between full time and part time from year to year, cannot be treated as a full time course of study (DMG39018 et seq).
