Deciding if a person is a self-employed earner: Sickness


If, at the date of application, a person cannot work due to sickness, the decision maker should still make a decision whether the business continues to operate (DMG31107). A person's sickness does not necessarily mean that the business is not generating an income. Like any other person a self-employed earner may have minor illnesses. These should be regarded as part of the normal pattern of self-employment.

Example

The applicant 's partner is a self-employed window cleaner. He is a sole trader. At the date of application he is off sick and cannot do his round for two weeks due to flu. The decision maker decides that the partner's business has not ceased; he is still self-employed and will return to the round when he recovers
