Members of a married or unmarried couple are treated as not
living in the same household if at the date of award one of them is
1) living in permanent residence in accommodation provided by
an LA under its obligation to provide accommodation for elderly,
infirm, handicapped or other people in need of care and attention
not otherwise available to them
or
2) an in-patient in hospital and has been for the last 52 weeks or more
or
3) detained as a patient in a special hospital or special security hospital, such as Broadmoor
or
4) detained in prison or youth custody serving a sentence of 52 weeks or more imposed by a court.
