The application has to be made by the disabled person. If both members of a couple satisfy all the qualifying conditions at DMG11009 (1 to 8) they are free to choose which one should be the applicant. There is no need for them to sign a statement nominating the applicant. The applicant should show that the partner agrees. The decision maker has power to require the partner's written agreement to the application but this power is generally not used. If the couple cannot agree, the decision maker will decide the applicant.
