CTM80525 - Consortia: group relief: claims:
rules limiting
ICTA88/S403A, ICTA88/S403C, ICTA88/S405, ICTA88/S406,
ICTA88/S411
There are a number of rules whose effect is to limit the amount
of consortium relief claimed.
- The general group relief rules about
apportionment of amounts to overlapping periods (
CTM80215) in Section 403A also apply to
consortium claims.
- Section 403C, broadly, limits the amounts
that can be surrendered and claimed by reference to percentage
ownership of the surrendering or claimant company. See
CTM80540 (claimant is consortium member)
and
CTM80545 (claimant is consortium
company) for more guidance on Section 403C.
- Section 405 governs the amount of relief
in a case where group relief may be available from a fellow group
member in addition to consortium relief. There is more guidance on
this at
CTM80580 and
CTM80585.
- Section 406 puts limits on the amount that
can be claimed or surrendered by a company in the same group as a
consortium member. There is more guidance on this at
CTM80550.
- ICTA88/S411 (
CTM80405) deals generally with the
exclusion of double allowances.
