Where a member of a co-operative housing association dies, his rights under the lease ( CTM40415) will pass to his personal representative for a limited period. Section 488 (10) provides that, for the first six months after the death of a member, occupation by non-members in accordance with his will, or under the provisions applicable on intestacy, shall be treated for the purposes of ICTA88/S488 (10)(b) as if it were occupation by a member. In practice, such occupation may be so treated for all the purposes of the relief.
