CTM34360 - Residence: avoidance transactions: Treasury consent
ICTA88/S765 and ICTA88/S765A
Until 15 March 1988 Treasury consent was needed for a company to:
- cease to be resident in the UK (subsection (1)(a)), or,
- to transfer its business to a non-resident (subsection (1)(b)).
Subsection (1)(a) and (b) was repealed by FA88/S105 (6) except for applications made before 15 March 1988. For migrations after that date see CTM34120. There are no special provisions for transfers of business to non-residents after 15 March 1988.
