COM41030 - Case records: case responsibility: transfer of cases in debt management office
Where you change a communication address on the company’s COTAX record it will not change the Debt Management office responsibility. An operator in the current responsible Debt Management office must make any necessary change.
When dealing with a case referred for local action, you may decide that it should be transferred to another Debt Management office for the following reason
- The company has moved outside your area
- You need to refer it to a specialist office, for example the Insolvency Handling Unit (ICHU)
- The case is the responsibility of the Large Business unit
You can transfer up to 25 cases that your office owns at any one time using Function TRCA. To do this, cases must all be transferred to the same Debt Management office.
Notes:
| 1. | You must bear in mind the important principle that in England and Wales, where County Court proceedings may be necessary, a defendant must not be summoned to a distant court |
| 2. | Whenever practical, all arrears due from a company which are working locally are transferred at the same time |
Once you have transferred responsibility for a case
- The new Debt Management office is responsible for updating the case
- Uncleared entries for this company on any Work List for which your office is responsible will be transferred to the new office
