CG64834 - Garden/grounds: permitted area: prima facie argument

There are two common circumstances in which this inference may be incorrect

a disposal within the family; family considerations may over-ride usual caution. In these circumstances the owner may be prepared to tolerate some curtailment of the reasonable enjoyment of their own residence.
financial necessity; financial difficulties may force a person to dispose of land which would be regarded as part of the most suitable area of garden or grounds to be included in the permitted area.
