CCM14360 - Closing the Enquiry: No response to settlement meeting proposals


Sometimes a claimant who has co-operated willingly with your enquiries will appear to withdraw co-operation once you are nearing the settlement stage. You might find they:


  • attend a settlement meeting but refuse to sign the letter of offer
  • attend a settlement meeting but do not return the letter of offer.

If the claimant makes it clear they are not prepared to co-operate with a negotiated contract you should follow the guidance at CCM14440.

Where the claimant does not return the letter of offer you should attempt to telephone them to discuss the settlement. If you cannot contact them or the telephone call still does not result in the letter of offer you should write to them. Refer to your meeting, enclose a further draft letter of offer and cover the points shown at CCM14370. Go on to say that if you do not hear from them within 14 days (or a longer period if you feel it is reasonable) you will have no alternative but to assume they are unwilling to make such an offer. Formal proceedings will then begin to recover the overpaid credits and any penalties/interest.
