CCM8140 - Closing the Examination: Informing the Claimant - Overpayment
In the majority of examinations the revised award will not lead
to an in-year recovery of overpaid credits. This is because most
potential overpayments will be reviewed following the Section 17
end of year declaration and only the net amount overpaid at the end
of the year will be recovered. The special circumstances in which
an overpayment can be recovered in- year are described at
CCM8125.
Where you are aware that the overpayment will be or is likely
to be recoverable in-year you should advise the claimant as soon as
possible even if you are not yet in a position to revise the award.
In addition to advising them that the overpayment will be repayable
30 days after the date of the revised award notice, if the
overpayment relates to fraud or neglect, you must warn them that
interest is payable if the overpayment is repaid late.

the claimant how this will be recovered – see
CCM8180.
