Where there has been

• no response to the opening letter or
• no response to the letter inviting an offer to pay the penalty or
• the claimant is still objecting to pay the penalty after you have followed the guidance at CCM4730 

you will need to consider formal penalty proceedings.

The submission should be made via your HO manager or, if appropriate, your support HO. The HO must be satisfied that the intervention has been correctly worked at all stages.
