CCM13220 - Discovery Decisions: Discovery - Contract Settlements

Whether your discovery enquiry is the extension of an enquiry under S19 or is being made in its own right (because the enquiry window for the year has closed), you should aim to include any liabilities for the years involved in your contract settlement, in the normal way (see CCM Chapter 8 - CCM8000 for guidance on settling the enquiry). If, however, the claimant(s) will not enter into a contract settlement, or if they do not accept that, as a result of your S19 enquiry, amendments are also appropriate for earlier years, you will need to make a formal discovery decision under S20.
