CCLG15470 - Assessments and Penalties: Failure to preserve records
A person who is registrable for CCL must have certain records and must preserve them for a period of 6 years. Regulation 9 of the CCL (General) Regulations stipulates the detailed requirements depending on the nature of the record. Anyone who fails to do so becomes liable under paragraph 125(6) of Schedule 6 to a penalty of £250. There is no daily penalty for failure to preserve records because once a trader has failed to preserve records, there is nothing he can do to rectify that failure, so it would be unfair to apply a daily penalty.
There is specific provision that this penalty shall not be imposed on a person who is either convicted of a criminal offence, or subject to a civil penalty under paragraph 98 of the FA 2000, Schedule 6, (civil penalty), for the same failure.
