Guardian’s Allowance Up-rating Regulations 2005
Social Security (Persons Abroad) Regulations 1975 regulation 5
From 11th April 2005, where a person who receives
Guardian’s Allowance is not ordinarily resident in either
Great Britain or Northern Ireland, they will continue to receive it
at the rate it was in payment when they moved abroad. If the claim
for Guardian’s Allowance was made from abroad, they shall
continue to receive it at the rate that was in payment when the
claim was made.
However, this provision does not apply in respect of persons
who come within European Community’s social security
legislation (
Regulation EEC 1408/71) or under
bilateral social security agreements.
