BLM74665 - Schedule 12 FA 1997: Part II: fourth condition - a Part I lease

The rule here is that Part I takes precedence. A Part II lease will be one which satisfies FA97/Sch12/Para3(1) (see BLM70426) but does not satisfy at the same time the other four conditions.
