Any special scheme may include a passenger survey to help
determine liability. Essentially, this means that the passengers
themselves are questioned to determine whether they fulfil any of
the criteria for exemptions from the duty.
The format of any such survey is subject to CAT approval. The
CAT should bear the following principles in mind:
- Any survey or questionnaire must be carried out by the aircraft operator. It is not the CAT’s responsibility to deal with passengers direct. An operator may be visited to observe a survey taking place.
- There is no legal requirement for a aircraft operator to survey passengers and any written or verbal survey should not imply otherwise.
- If a aircraft operator wishes to survey a sample of passengers, then the rules for sampling must be followed as detailed in APD8500.
- Any claims by passengers that they are exempt must be supported by suitable evidence.
