If you are giving evidence before the Commissioners you will
need to prepare a Witness Statement. A witness statement is a
written statement signed by a person which contains the evidence
which that person would be allowed to give orally. It must be a
statement of facts, not arguments. It is suggested that you prepare
the statement in the form of short, numbered paragraphs, one fact
per paragraph.
Witness statements are not normally admitted routinely in
appeals falling within the jurisdiction of Scots law. The witness
is expected to attend and their evidence established by
examination.
