AH1520 - General Commissioners: Appeals to the High Court: Demanding a case


Do not demand a case except on the instructions of Head Office. If you receive such instructions, deliver notice in writing at once to the Clerk to the General Commissioners requiring a case to be stated and signed for the opinion of the Court. At the same time pay the fee of £25 to the Clerk. (The fee should be paid by a cheque drawn on the official banking account).

Inform the appellant (or his agent) that you have asked for a case to be stated.

You should ensure that you have as much material as possible prepared in readiness for the report which must be made under AH1540 when the draft case is received.
