AH1510 - General Commissioners: Appeals to the High Court: Fact or law


No case can be demanded on a pure question of fact, but it is a question of law whether there was evidence on which the findings of fact by the Commissioners might be based (New Zealand Shipping Co Ltd v Stephens, 5TC553; Currie v CIR and Durant v CIR, 12TC245. See also Edwards v Bairstow and Harrison 36TC207).
