Whilst the Commissioners Regulations relating to expert evidence do not apply in Scotland, it is usual for both sides to agree, in appropriate cases, to exchange experts' reports in advance of hearings. Or, in appeals before the Special Commissioners, to agree to a direction from the Commissioners requiring the exchange of such reports.
