RE1951 - Mineral rights: management expenses: basis of relief


A lessor may grant more than one mining lease in respect of the minerals on an estate. Where he does so he may make


  • one claim in respect of the estate or
  • a separate claim in respect of the minerals included in each lease.

Where a lessor each year makes up his accounts to a date other than 5 April you can give relief on the basis of the expenses of management or supervision shown in the accounts ending within the year of claim. Before you apply this basis the claimant must agree in writing that it is also to apply to later years.
