IHTM39026 - Review of future claims: reviewing F(Rev Rev) cases

When the file is received in Compliance Group, the appropriate E1 will check the Calendar of Grants and ALF to see if there is any trace of the Reversioner.

If a record exists the file will be ordered, and on receipt of the file it should be sent to the nominated Compliance Group caseworker. These files should be cross -referenced on ALF by FACET (this can be done by sending a memo without the file).

If there is no trace of the Reversioner on ALF, you should check to see if the name and address are shown on the BT Phone disk. If a record exists, it would suggest that the Reversioner is still alive and you should BU the case accordingly. If no record is found, then fill in the Future Claim Rev 8a, using details from any previous Rev 8a, confirming the solicitor’s address/DX in the Waterstones Directory.

Print three copies of the Rev 8a. Stamp one with “ copy for retention” and send it with a signed copy to the solicitors. Attach a third copy to the file cover and BU for two months.

If no response from the parties after two months, send a reminder with a copy of the original Rev 8a, put a copy of the reminder on the on file and BU for a further month. If still no response after the month, refer the file to the nominated caseworker.

If the parties state that the Reversioner is not alive, they should provide a date of death. If so, please check ALF for the existence of a file, and order the same. Link this file with the original and send both to the nominated caseworker. If a file cannot be found in respect of the deceased, then still send the main file to the nominated caseworker.

If the Rev 8a enquiry is returned undelivered, then it may be necessary to try and trace the parties.

Please look through the file for the latest correspondence from the parties. This should show a list of partners and members of any solicitors/accountants. Check the last named solicitor against the Waterstones Solicitor’s and Barrister’s Directory. These names, will be found under the section ‘Individual Solicitors, London and County A-Z.’ This will show the present company the solicitor is with. Check some of the other solicitors’ listed on the file correspondence, and if they are too with the other firm, it is likely that they have merged. Note their telephone number and call to enquire whether or not the company has merged/taken over with this new firm.

The telephone disk may also be of assistance in this regard, otherwise you can telephone the Law Society on 020 7242 1222, or the Institute of Chartered Accountants for England and Wales, Registration Department on 020 7920 8100

If all else fails refer the cases to the nominated caseworker, especially if you have insufficient information to complete the Rev 8a.
