IHTM39013 - Future claims: closing a file where an “F(CT)” marking is appropriate

When a file is ready for closing you should consider whether under the terms of the deceased’s will, or Intestacy (as varied by any Instrument of Variation ( IHTM35011) or Settlement - there is settled property

  • in which an interest in possession exists, or
  • there is no interest in possession.

Then where an interest in possession in settled property is found to exist, even if it is a limited interest such as

  • A life interest
  • An annuity
  • A right to occupy a house

However, if after checking on ALF, a settlement file has already been created to deal with that interest, you do not need to send a SL 116.
