IHTM38133 - Land charges: England & Wales: registered land and the Land Registry


At present, there are 18 regional offices in England and Wales called District Land Registries (DLRs). Each DLR serves certain allocated counties including the former metropolitan counties or, in London, London boroughs. Any questions or queries regarding land charges should be directed to the Customer Service Manager at the relevant Land Registry. The names and contact numbers are contained in the Land Registry Liaison folder.

The Land Register comprises three parts, the Property, Proprietorship and Charges Register.

The Property Register describes the property and invariably refers to a filed plan. Since there may be more than one estate in the land (freehold, leasehold etc) there may be more than one register entry for the same land. Each estate has its own entry and its own title number.

The Proprietorship Register shows the type of estate registered and the class of the title (freehold, good leasehold etc). It also gives the name of the registered owner of the estate and his address. This part of the register will record any restrictions on the power of the proprietor to deal in the land, for example if he is a trustee or a bankrupt.

The Charges Register carries the details of any encumbrances registered against the estate (restrictive covenants etc), in fact any minor interests in the land, as well as legal charges, ie mortgages.
