Why hasn't there been a formal consultation about this measure?
There has been extensive consultation about this measure. Some people have suggested that, because the Government did not publish a Consultative Document in the usual format, there has been no proper consultation on the measure. This is not correct.
Unusually for anti-avoidance legislation, the Chancellor announced his intention to act against avoidance in this area a full year before the changes are due to come into effect.
Between May and the end of August 1999, the Inland Revenue had sent out over 1800 copies of the original proposals and held two consultative meetings with 38 representative bodies. Over 1700 written comments and suggestions were received, considered and used to help formulate the present modifications.
This is a consultation exercise on a large scale. And the result has been changes to the proposals to minimise their effects on legitimate business.
