Nationality rules
All posts are subject to Civil Service nationality rules and individual advertisements will explain the nationality requirements for that post, describing them as ‘reserved’ or ‘non-reserved’.
If a post is described as ‘reserved’, then you must be a UK national to be able to apply.
If a post is described as 'non-reserved', you are eligible to apply if you are a:
- UK national
- Commonwealth citizen
- national of the European Economic Area (EEA)
- Swiss or Turkish national (subject to certain restrictions)
Certain family members of EEA, Swiss and Turkish nationals who are not themselves EEA, Swiss or Turkish nationals, are also eligible.
Restrictions
If you are a Bulgarian or Romanian national you can apply for these posts but will not be able to take up duty until approval for the employment, under the work permit arrangements as set out in the Accession (Immigration and Worker Authorisation) Regulations 2006, has been obtained.
If you are a non-exempt national of Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Slovakia or Slovenia, you must obtain a registration certificate within the first month of employment to allow you to continue to work in the UK.
To be exempt, you must have 12 months’ continuous lawful employment in the UK or a work permit confirming that you have no Home Office restrictions on working in the UK.
Turkish nationals must have been lawfully employed in the UK for four years in any job, or for three years in a job with the same occupation as the post which they wish to take up within the Civil Service.
Certain family members of EEA nationals, Swiss nationals and Turkish Nationals may also be eligible to apply.
Rehabilitation of offenders
HMRC has an exemption under the Rehabilitation of Offenders Act 1974 (Exceptions order 1975). Applicants who are successful in reaching the interview stage of the recruitment process will be asked to declare details of any criminal convictions, including spent convictions and cautions, to allow basic security checks to be completed.
Declaring a criminal conviction will not necessarily prevent you from being successful in your application for this particular programme, but it may exclude you from applying for other posts within the department.
