New legislative framework
The high level objectives of the new powers are:
- modernisation of HM Revenue & Customs (HMRC)
- alignment of rules where appropriate
- building in safeguards
- a new department that feels different from its predecessors
- behavioural change
The new legislative framework for powers contained within Finance Act 2008 (FA08) is:
- inspection powers - Schedule 36
- information powers - Schedule 36
- record keeping - Schedule 37
- time limits - Schedule 39
- access and inspection of any computer - Section 114
