The Offshore Funds (Tax) Regulations 2009 - Draft for Information
The government announced at Budget 2009 that, subject to approval by the House of Commons, regulations to provide for the taxation of investors in Offshore Funds would be made before 1 December 2009 and would come into force on that date.
The attached draft of these regulations is, subject to final technical and legal checks, the draft that the government intends to ask the House of Commons to approve.
The draft regulations are being published now for the information of industry and of advisers to industry.
HM Revenue & Customs (HMRC) also intends to publish draft guidance on these regulations as soon as possible.
If there are any changes in the final version of the regulations as laid before the House of Commons then HMRC will publish a note at that time to draw attention to those changes.
