Residence & Domicile (FA 2008) Stakeholder Group Terms of Reference

To provide a forum in which HMRC, HMT and representatives of tax advisers and the accountancy profession, law societies and others, can discuss and review in a frank and open manner the operation of the new FA 2008 residence and domicile legislation to ensure that it is working as intended by Parliament. The group will need to be mindful of the Chancellor’s commitment not to make further substantive changes to the regime for the remainder of the current Parliament and the next.

The meeting will be chaired by HMRC and take place under 'Chatham House' rules. The minutes will be agreed by those attending the meeting before being published on the HMRC internet.

Agenda items will be compiled by the secretary of the group from suggestions by any group member. Agenda items and papers will be submitted one week in advance of the meeting.

The next meeting will normally be scheduled under 'Any Other Business', although any member of the group may request an earlier meeting should there be reason.

Attendance at meetings will vary according to interest in agenda items submitted, although all members will be invited to each meeting unless a specific sub-group is set up with the agreement of the meeting. Any sub-groups set up will report to the meeting as a whole. Requests to join the group may be made at any time, and substitutions for or additions to regular delegates from member representative bodies will be welcomed.

Given the time limited scope of the group’s role it is envisaged the forum will end by August 2009.
