My Personal Service Company pays my wife a salary, on which she pays tax and NICs. Will the IR35 legislation affect her entitlement to statutory benefits?

Nothing in the legislation will affect entitlement to benefits in return for NICs paid; therefore your wife's entitlement will not be affected.
